Terms and Conditions
Please read these Terms and Conditions carefully, with particular attention to the cancellation conditions.
We would urge you to take out Holiday Insurance (for only a few dollars), as it will cover your deposit in the event that you have to cancel your trip.
Bookings: A deposit of $400 is required to secure the charter. The balance is required 30 days prior to departure. Christmas, New Year, Easter & Long Weekends a deposit of $1000 is required with the balance due 90 days prior to departure. Monies can be paid by credit card, bank transfer or cheque.
Security Deposit: A bond of $1000 cash or credit card must be lodged before departure. The bond will be refunded shortly after return, less any unpaid fuel charge, cost of repairs or damage to boats or equipment or cost of extra cleaning. We reserve the right to hold the bond for up to 7 days, until any costs can be ascertained.
Charter Contract: A charter contract stating the conditions under which the boat is chartered will be entered into before commencement of the charter period. Provided this contract is adhered to, liability for damage to the boat or equipment will be limited to the amount of the security bond. If the contract is breached, liability will not be so limited.
The Charter: The charter is made on the understanding that the boat is placed at the disposal of the hirer on the date booked unless the management is prevented from doing so by mechanical breakdown or unforeseen circumstances. Should that occur, all monies paid will be refunded in full. However, the hirer shall have no claim on any account against the proprietors.
Cancellation: Deposit refunded (less booking fee of $100) 60 days (90 days peak periods) prior to charter. Thereafter refunded less booking fee if the boat is rechartered. Full payments are refunded subject to the vessel being rechartered for the full fee & period.
Minimum Age: At least one person per group must be over 21 years of age, and remain aboard during the charter.
No Warranty: Except as required by law, the Proprietors give no warranty whatsoever in relation to the operational condition of the vessel. The Hirer will have no claim against the Proprietors in respect of any loss, damage or injury arising out of the operational condition of the vessel.
Indemnity: The Hirer is liable for and irrevocably and unconditionally indemnifies the Proprietors against all liability, loss, penalties, payments,costs, charges and expenses directly or indirectly arising out of the Hirer’s failure to comply with the terms and conditions of the hire agreement and any Local, State and Commonwealth laws relating to the use of the waterways.
